Unless expressly stated otherwise, we do not provide:

• Licensed appraisal services

• Legal representation

• Insurance adjusting services

• Engineering inspections

• Physical vehicle inspections

2. Eligibility

By using our Services, you represent and warrant that you:

• Are at least 18 years of age

• Have the legal capacity to enter into a binding agreement

• Are the legal owner of the vehicle or have authorization to act on the owner's behalf

3. Independent Service & No Guarantee

ValueReturn Analytics LLC is an independent vehicle analytics company. We are NOT an insurance company, insurance carrier, law firm, licensed public adjuster, governmental agency, or licensed vehicle appraisal company unless expressly stated otherwise.

Our Services consist of independent analytical reports and diminished value analyses prepared using customer-submitted information, proprietary analytical methods, publicly available market data, and industry-recognized valuation methodologies. Our Reports are not licensed appraisals, engineering reports, legal opinions, governmental determinations, or insurance claim decisions.

Nothing in these Terms creates a partnership, joint venture, agency, employment, fiduciary, attorney-client, or other professional relationship between you and ValueReturn Analytics LLC.

Our Reports are provided solely for informational and analytical purposes. Although they are prepared using recognized valuation methodologies and market data, we do not guarantee or warrant that any insurance carrier, adjuster, attorney, arbitrator, governmental agency, or court will accept, rely upon, or compensate the valuation contained in our Report.

Customers are solely responsible for determining whether a Report is appropriate for submission to an insurance carrier, attorney, court, or any other third party.

Results may vary depending on applicable law, insurance carrier policies, jurisdiction, and the individual facts of each claim.

4. Accuracy of Information

You are solely responsible for the completeness, authenticity, and accuracy of all information submitted through our website or intake forms, including but not limited to:

• Vehicle information and VIN

• Repair estimates and invoices

• Photographs and damage documentation

• Mileage and accident details

We do not independently verify submitted information for accuracy or authenticity. ValueReturn Analytics LLC shall not be responsible for inaccurate reports, denied claims, delayed processing, or reduced settlements resulting from incomplete, incorrect, misleading, or fraudulent information supplied by you.

5. Orders & Payment

All Services require payment in full prior to commencement unless expressly stated otherwise.

Payments are securely processed through trusted third-party payment providers.

An order is considered accepted only after successful payment has been received.

Prices may change without prior notice; however, changes will not affect orders that have already been accepted and paid for.

6. Refund Policy

Due to the custom, digital, and personalized nature of our Services, each report is individually prepared based on unique customer information.

Once work on a report has commenced, purchases are generally non-refundable.

Our separate Refund Policy forms part of these Terms and should be read together with this Agreement.

7. Intellectual Property

All website content, branding, software, analytical methodologies, report layouts, graphics, templates, documentation, text, logos, and proprietary materials are the exclusive intellectual property of ValueReturn Analytics LLC.

Upon full payment, you receive a limited, non-exclusive, non-transferable license to use your completed Report solely for your personal insurance claim evaluation or personal records.

You may not reproduce, resell, modify, publish, distribute, sublicense, or commercially exploit our reports or any proprietary materials without prior written permission.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VALUERETURN ANALYTICS LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND.

THIS INCLUDES, WITHOUT LIMITATION, DENIED INSURANCE CLAIMS, REDUCED SETTLEMENTS, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, ATTORNEY'S FEES, EMOTIONAL DISTRESS, OR DELAYS CAUSED BY THIRD PARTIES.

OUR TOTAL MAXIMUM CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NEVER EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO VALUERETURN ANALYTICS LLC FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless ValueReturn Analytics LLC, its members, managers, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or reasonable attorneys' fees arising out of or relating to:

• Your breach of these Terms

• Your misuse of our Services or Reports

• Inaccurate, misleading, or fraudulent information submitted by you

• Your violation of applicable law

10. Governing Law

These Terms shall be governed exclusively by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

11. MANDATORY ARBITRATION & CLASS ACTION WAIVER

YOU AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA"), WHERE PERMITTED BY APPLICABLE LAW.

YOU AND VALUERETURN ANALYTICS LLC EACH WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

12. Privacy

Your use of our Services and submission of personal data through our Website and trusted third-party service providers is governed by our Privacy Policy, which is incorporated into these Terms by reference.
